1. Acceptance of this Agreement
Welcome to PMP Mastery (“App”).
This End User License Agreement (“Agreement”) is entered into between you and X-SOFT (“X-SOFT”, “we”, “our”, or “us”), the developer and licensor of PMP Mastery, and not Apple Inc.
By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree to these terms, you must not use the App.
2. Eligibility and User Accounts
Certain features require you to create an account using Apple Sign In or Google Sign In.
You agree to:
- Provide accurate and complete information.
- Maintain the confidentiality of your account credentials.
- Notify us immediately of any unauthorized access.
- Accept responsibility for all activities performed under your account.
3. License Grant
Subject to this Agreement, X-SOFT grants you a limited, non-exclusive, non-transferable, revocable license to use PMP Mastery solely for your personal, non-commercial educational purposes.
This license does not transfer ownership of the App or any intellectual property rights.
4. Subscriptions and In-App Purchases
PMP Mastery offers premium content through auto-renewable subscriptions.
By purchasing a subscription you acknowledge that:
- Payment is charged to your Apple ID or Google Play account upon confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period.
- Your account will be charged for renewal within 24 hours before the end of the current billing period.
- Subscription pricing will be the price displayed at the time of purchase.
- You may manage or cancel your subscription through your Apple App Store or Google Play account settings.
- Refund requests are handled exclusively according to Apple’s or Google’s policies. X-SOFT does not process subscription refunds directly.
5. Intellectual Property
The App and all associated content—including practice questions, mock exams, study materials, graphics, logos, text, software, educational resources, and other materials—are owned by X-SOFT or its licensors and are protected by copyright, trademark, and applicable intellectual property laws.
You may not:
- Copy or reproduce any content;
- Modify or create derivative works;
- Sell, license, or redistribute any content;
- Reverse engineer, decompile, or attempt to extract the App’s source code except where permitted by applicable law.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose;
- Circumvent security or access controls;
- Interfere with the App’s operation or infrastructure;
- Upload malicious software or harmful code;
- Use automated tools to scrape or extract content;
- Share premium content without authorization.
Violation of these terms may result in suspension or permanent termination of your account.
7. Educational Disclaimer
PMP Mastery is an independent educational platform designed to help users prepare for professional certification examinations.
We do not guarantee:
- Passing the PMP® certification examination;
- Any examination score;
- Employment;
- Promotion;
- Professional certification.
Your success depends entirely on your own preparation and performance.
8. Disclaimer of Warranties
The App is provided “AS IS” and “AS AVAILABLE.”
To the fullest extent permitted by applicable law, X-SOFT disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of:
- Merchantability;
- Fitness for a particular purpose;
- Non-infringement;
- Continuous availability;
- Error-free operation.
9. Limitation of Liability
To the fullest extent permitted by law, X-SOFT, its affiliates, licensors, employees, contractors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from:
- Your use of the App;
- Inability to use the App;
- Loss of data;
- Loss of profits;
- Examination outcomes;
- Reliance on educational content.
Our total liability shall never exceed the total amount paid by you for the App or subscriptions during the previous twelve (12) months.
10. Maintenance and Support
X-SOFT is solely responsible for providing maintenance and support services for PMP Mastery.
Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
11. Product Claims
X-SOFT is solely responsible for addressing any claims relating to the App, including but not limited to:
- Product liability claims;
- Claims that the App fails to conform to applicable legal or regulatory requirements;
- Consumer protection claims.
12. Intellectual Property Claims
In the event of any third-party claim alleging that the App infringes intellectual property rights, X-SOFT shall be solely responsible for investigating, defending, settling, and discharging such claims.
13. Export Compliance
You represent and warrant that:
- You are not located in a country subject to a U.S. Government embargo.
- You are not listed on any U.S. Government list of prohibited or restricted parties.
14. Termination
We reserve the right to suspend or terminate your access to the App if you violate this Agreement or misuse the App.
Upon termination, all rights granted under this Agreement shall immediately cease.
15. Changes to this Agreement
We may update this Agreement from time to time.
When changes are made, the Effective Date at the beginning of this Agreement will be updated.
Your continued use of the App after any modification constitutes acceptance of the revised Agreement.
16. Governing Law
This Agreement shall be governed by the laws of Angola, except where mandatory consumer protection laws require otherwise.
17. Apple Third-Party Beneficiary
You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement.
Upon your acceptance of this Agreement, Apple shall have the right (and shall be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
