By downloading or using PixScan (the “App”), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the App.
1. Acceptance of Terms
By accessing and using PixScan, you accept and agree to be bound by the terms and provision of this agreement. Use of the App constitutes your acceptance of these Terms of Use and the accompanying Privacy Policy.
2. License
X-SOFT grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with the terms of this Agreement.
3. Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make the App available to any third party.
- Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.
- Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of X-SOFT or its affiliates, partners, suppliers, or the licensors of the App.
4. Subscriptions & Payments
PixScan offers a Premium subscription (“Pro”) that unlocks additional features.
- Payment: Payment will be charged to your iTunes or Google Play Account at confirmation of purchase.
- Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
- Management: You can manage or turn off auto-renewal in your Account Settings at any time after purchase.
- No Refunds: No cancellation of the current subscription is allowed during the active subscription period. All refunds are managed directly by Apple or Google.
5. Intellectual Property
The App, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights are, and shall remain, the sole and exclusive property of X-SOFT.
6. Your Content
You retain ownership of any documents, images, or data (“Content”) that you scan, import, or create using PixScan. We do not claim ownership of your Content. You are solely responsible for the Content you process using the App.
7. Disclaimer of Warranties
The App is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, X-SOFT expressly disclaims all warranties, whether express, implied, statutory, or otherwise.
8. Limitation of Liability
In no event shall X-SOFT be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption) arising out of or in any way related to the use of or inability to use the App.
9. Changes to Terms
X-SOFT reserves the right, at its sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.
